Alabama lets you wholesale — if you disclose it.
Alabama took a lighter path than most states: it requires wholesalers to disclose their intent, but you can still assign a contract without a license. Here's the plain-English version, and where a double close and funding still fit.
What the law does
Alabama's SB 228, effective August 1, 2023, took a disclosure approach rather than a licensing one. In plain terms: if you have a home under contract and intend to assign or resell that interest, you have to disclose that intent to the homeowner — that you hold a contract, not title, and that you plan to profit by transferring it. With that disclosure, you can still wholesale; Alabama does not require a license to assign the contract.

Where a double close still fits
Because Alabama allows assignment with disclosure, the double close here usually isn't about the wholesaling law — it's about the deal. Your end buyer's lender may require the seller (you) to hold title before reselling; you may not want your spread visible on a settlement statement both sides can see; or the transaction simply works better as two closings. In those cases you actually buy the home from the seller, take title, then sell to your end buyer, often the same day.
Where transactional funding fits
We fund the purchase for the short window between the two closings, repaid out of your buyer's proceeds, so your own capital stays free. You bring a real end buyer and a closing agent; we bring the money for the hours in between.
Budget for it honestly. A double close means a second set of closing costs — commonly around 3% — plus the funding fee. When an assignment would work just as well — and Alabama allows it with disclosure — that's often the cheaper path. Run the numbers first.
